The seller's death does not itself invalidate a preliminary property agreement. Financial obligations may pass to heirs who accept the estate. An existing power of attorney is not a way to continue signing for the deceased: authority terminates on death.
It identifies statutory heirs but does not settle every question about wills, renunciation, acceptance under inventory or applicable foreign law. Before paying the balance, establish who can complete and validly receive payment. Agreement with one heir may not secure the whole property.
Keep the original agreement, amendments and advance-payment records. Inform identified heirs of the agreement and your readiness to perform. If they agree, prepare completion with the actual successors and additional documents required.
If disagreement persists, a claim seeking a judgment in place of the final contract may be considered, subject to proof of ownership and the statutory conditions. Death does not automatically entitle you to twice the deposit or allow unlimited delay. Where an heir will not decide whether to accept, legislation provides a court procedure for setting a period; a private ultimatum is not equivalent.
