A handwritten will leaves you an apartment in Bulgaria: what comes before sale?

A newly found handwritten will is not a complete sale file. Check its announcement, form, the deceased's title and competing inheritance rights.

The essentials

  • Keep the original document unaltered.
  • Announcement does not finally determine validity.
  • Only the testamentary rights actually acquired can be sold.

Before offering a Bulgarian apartment left by will for sale, establish the will's effect, the deceased's title and the necessary documentary steps. Finding the paper or having it formally announced by a notary does not establish that every disposition is valid and beyond challenge.

Preserve the original and distinguish the procedures

A Bulgarian handwritten will has strict requirements: the testator must write it entirely by hand, date it and sign in the required position. Do not annotate or correct it. The person holding it must seek its announcement after learning of the death.

Formal announcement records the document through the prescribed procedure. It does not finally determine disputes about authorship, capacity or protected inheritance shares. For a disposition involving real estate, check registration of the appropriate copy as well.

Identify the rights actually left

A will covering the whole estate and a legacy of a particular apartment have different consequences. Establish whether the deceased owned the entire apartment: describing it as “my apartment” does not remove a spouse's or co-owner's share.

Gather the deceased's title, death record, certificate of heirs and all known wills. Before a deposit, the buyer should receive a clear chronology and information about any actual dispute. Silence from relatives does not justify a promise that no inheritance claims can arise.
