The essentials

  • The certificate evidences the rights it actually specifies.
  • Bulgarian location alone does not determine succession law.
  • Annexes, restrictions and copy validity need examination.

A European Certificate of Succession can help an heir establish their legal position in another participating EU Member State. It is not universally mandatory for every sale and does not replace the notarial instrument transferring Bulgarian property.

Establish the succession regime first

An apartment's location in Bulgaria does not automatically make Bulgarian law govern the entire inheritance. The deceased's habitual residence, a choice of applicable law and the date of death may matter. Regulation 650/2012 applies within its temporal scope; Denmark and Ireland do not participate in this regime.

A Bulgarian certificate of heirs, a foreign national document and a European Certificate should therefore not be treated as interchangeable without examining what each establishes.

Read the annexes and check the copy

The certificate may establish the position of heirs or legatees, or powers of estate administration. A sale requires attention to the particular persons, shares, restrictions and powers certified. The certified copy states its validity period; an old scan is not automatically a usable current document.

Match the certified rights to the title and identification of the Bulgarian asset. Matrimonial property must also be distinguished from the estate. Early coordination with the notary helps identify translations and supplementary documents before heirs travel or commit to a contractual timetable.

Practical guidance

What to do, step by step

Its heading is not enough.

  • Read the annexes identifying shares and representative powers.
  • Check the certified copy's expiry date.
03 / 03

Prepare the Bulgarian closing

Coordinate before arranging travel.

  • Match the asset to title and cadastral records.
