A Bulgarian notarial or registration refusal: how to respond

The written refusal, reasons and service determine the remedy. Refiling does not necessarily preserve the original application’s priority.

The essentials

  • Obtain the refusal itself and proof of notification.
  • Correction and appeal can have different effects.
  • The original application’s priority may matter.

A refusal to perform a Bulgarian notarial certification or registration is not necessarily the final word on the transaction. Article 577 of the Civil Procedure Code provides for an interlocutory appeal to the regional court. First identify the authority, the act requested and the precise reason for refusal.

Distinguish advice from a formal refusal

A request for more documents or a preliminary discussion is not necessarily an appealable act. Obtain the refusal, application, attachments and proof of notification. Article 275 generally provides one week from notification for an interlocutory appeal, subject to the applicable procedural rules. Negotiations do not extend it.

Correct the application or appeal

A missing document may sometimes be addressed by a fresh application. A disputed legal assessment may require a reasoned appeal. Do not assume every omission can first be cured before the appellate court: the particular procedure and original application file matter.

Where a registration refusal is overturned, Article 577(3) relates registration back to the original application. A fresh independent application may have a different priority against intervening registrations. This matters where rights compete. Also review any contractual payment deadlines linked to successful registration.

Practical guidance

What to do, step by step

01 / 04

Obtain the entire file

Identify what was refused.

  • Collect the application and attachments.
  • Retain the notification and receipt date.
02 / 04

Calculate the deadline

Work from the actual decision.

  • Check the procedure and competent court.
  • Do not substitute an oral objection for an appeal.
03 / 04

Choose the next step

Consider intervening rights.

  • Compare refiling with appealing.
  • Review payment obligations and subsequent registrations.
04 / 04

Follow through on registration

A successful appeal must result in the appropriate recorded action.

  • Obtain the judicial decision and check implementation by the registry.
  • Compare the registered instrument and its effective priority with intervening rights.
