The essentials

  • Proof of identity and correction address different problems.
  • A correction cannot create title to additional property.
  • Resolve discrepancies before agreeing an unrealistic completion date.

A mismatch between an old title deed and current documents does not necessarily mean ownership is disputed. First distinguish an actual error from a lawful change of name or address, or a description of a different property. Each needs a different response.

Changed details may only need connecting evidence

A pre-marriage surname may be linked to the current name through civil-status records. A former street number may need evidence of an administrative change. Such records explain identity; they do not create missing ownership or enlarge the property sold.

When correction needs consideration

Incorrectly recorded details may require a notarial correction supported by evidence of the original transaction. The procedure depends on the type of deed and error. Do not alter the original yourself or assume a seller's declaration resolves the issue. A proposed correction introducing another property or a larger share may require a new transaction or resolution of an ownership dispute.

Show the discrepancy to the notary before promising a short completion deadline. If the deed is correct but the register entry is wrong, the relevant registration procedure should be considered instead of changing the deed.

Practical guidance

What to do, step by step

01 / 03

Compare original records

Identify the exact conflicting details.

  • Compare the deed with civil records and the current cadastral plan.
  • Separate errors in the deed from registration errors.
02 / 03

Document the connection

Obtain evidence directed at the actual discrepancy.

  • Seek evidence of name or address changes where relevant.
  • For property descriptions, include earlier deeds and surveying advice.
03 / 03

Agree the procedure

Plan correction before completion.

  • Confirm required participants and form with the notary.
  • Check the outcome in the relevant registers.
