The Bulgarian encumbrance certificate is clean: what else should you check?
Property encumbrance checks in Bulgaria: why a clean certificate does not settle every title question and what else to review before buying.
Read article →A boundary discrepancy may need a cadastral correction or a court judgment. Compare title, historic plans and a professional survey before choosing a route.
If the cadastral map shows a boundary inconsistent with your documents, establish the cause first. Where an omission or error involves a dispute over substantive property rights, Article 54(2) of the Cadastre and Property Register Act requires the dispute to be resolved in court before correction.
Cadastral information has statutory evidential significance, but a drawn line does not by itself transfer a neighbour's land. Equally, an old fence does not establish that your deed covers everything behind it.
Ask a qualified cadastral professional to compare the current map, historic plans and measurements. An area discrepancy alone does not prove that a physical strip has been taken; the boundary location and permissible measurement tolerances matter.
Correction requires written evidence and an amendment project. If the neighbour claims title to the disputed area, an administrative application should not be treated as a substitute for judicial determination of ownership.
After a final judgment, arrange cadastral implementation with the necessary project. Winning the case and correcting the map are separate completed steps. If a cadastral order has already been served, retain the notice and check the challenge deadline promptly. Proceedings begun before 9 February 2026 require attention to the transitional rules.
