Can a Bulgarian property gift be revoked after support is refused?

Family conflict alone does not revoke a property gift. Need, a request, refusal and the recipient’s means must be examined.

The essentials

  • Family conflict alone does not revoke a gift.
  • Need, the request and the recipient’s resources require evidence.
  • Timing and later property rights affect the remedy.

A donor cannot recover a Bulgarian home merely because relations with the recipient deteriorate. Article 227 of the Obligations and Contracts Act permits revocation on specified grounds, including refusal to provide maintenance which the donor needs. This differs from breach of a property-for-care agreement.

Establish need and refusal

Collect evidence of income, assets and necessary expenditure, rather than relying only on a low pension. A request should make the required support understandable. Keep evidence that it reached the recipient and of the response or subsequent conduct.

The Supreme Court also considers the recipient's actual means. Refusal does not constitute ingratitude on this ground where insufficient resources mean that providing support would leave the recipient and those they must legally maintain worse off than the donor. Having received a home in the past does not make this inquiry irrelevant.

Check time and subsequent transactions

The statute provides a one-year period from learning of the ground for revocation. With continuing need and different refusals, commencement should not simply be calculated from the gift date. Third-party rights acquired before notation of the claim receive specific protection, with an accounting remedy against the recipient. Check whether the recipient still owns the property before expecting its physical return.
