Transferring Bulgarian property in return for maintenance and care

Define accommodation, maintenance and practical care before transferring a home. Ownership passes during life, and non-performance does not automatically undo it.

The essentials

  • Ownership passes during the transferor's lifetime.
  • Care obligations should reflect actual needs.
  • Non-performance does not automatically return the property.

A Bulgarian agreement transferring property in return for maintenance and care transfers ownership during the transferor's lifetime. The counter-obligation must meet the agreed needs. It is not a will that can simply be replaced by a later decision.

Turn expectations into workable duties

Discuss where the transferor will live and how food, medication, illness-related assistance and daily care will be provided. Specify whether the obligation is comprehensive or limited, who organises assistance and how changing health needs will be addressed.

Do not assume the older person's own income automatically releases the recipient from maintenance duties. The agreement and applicable rules determine their scope. A bank transfer alone does not necessarily establish performance of promised personal care.

Protect occupation separately

If the transferor is to remain in the home, consider an expressly retained property right of use and define its scope. The care arrangement should not leave accommodation uncertain. Check existing mortgages and third-party rights as well.

If substantial non-performance occurs, the property does not return through a unilateral cancellation of the deed. Rescission of a contract transferring rights in real estate requires judicial proceedings. Keep evidence of assistance actually provided or missing rather than allowing the record to consist only of later accusations.
