Selling one Bulgarian home to buy another: coordinating a property chain

Two transactions do not become legally linked merely because one funds the other. Coordinate payment, completion and possession in both contracts.

The essentials

  • The two contracts remain separate unless suitable terms connect them.
  • Actual receipt of funds matters more than the signing date.
  • The plan must also cover keys, temporary accommodation and contingency dates.

If buying your next home depends on selling the current one, you have two separate contractual relationships. Failure of your sale does not automatically release you from obligations to your own seller. Lack of funds alone does not excuse contractual responsibility.

Signing does not mean cleared funds

Your buyer may use mortgage finance released only after registration and satisfaction of bank conditions. Promising payment for your new home before those funds arrive creates a gap even if both deeds are signed. Build the schedule around confirmed payment mechanics, not only notary appointments.

Expressly negotiate the dependency

Conditions, coordinated final dates and extension arrangements may be possible, but their effect depends on the wording and each party's consent. Establish what happens to advance payments if the first sale falls through and which risks you retain. Do not assume every delay amounts to force majeure.

Plan possession separately. An immediate obligation to vacate your old home combined with delayed handover of the new one can leave you without accommodation despite successful payment.

Practical guidance

What to do, step by step

01 / 03

Create a combined timetable

Include each lender's conditions.

  • Identify the earliest reliable receipt of your sale proceeds.
  • Add payment, registration and possession dates.
02 / 03

Align the clauses

A party is not bound by someone else's contract.

  • Agree feasible conditions and extensions in both contracts.
  • Address advances and penalties if the chain breaks.
03 / 03

Prepare a workable fallback

Assess its practical and financial cost.

  • Explore temporary occupation or alternative accommodation.
  • Assess any additional borrowing separately before committing.
