The seller will not hand over the keys after your Bulgarian property purchase

Ownership and physical handover are separate. Document the refusal, check the agreed occupation period and use the appropriate legal route.

The essentials

  • Ownership does not prove physical handover.
  • An inaccurate acceptance record can undermine your evidence.
  • Use lawful recovery procedures rather than changing the locks yourself.

A notarial deed may transfer ownership before you physically receive the home. If the agreed handover deadline has passed, the seller may be in breach. First establish the precise promise: vacant possession, a specified date or permission for temporary occupation.

Record the actual handover position

Do not sign a statement confirming possession if the property remains occupied and you lack the agreed access. Handover involves more than one key: cleared rooms, agreed furnishings and a record of condition and meter readings. Keep evidence of refusals and proposed appointments.

From demand to lawful enforcement

A written demand can establish what you require and clarify default, but it does not authorise removing an occupier yourself. The appropriate claim, or any document-based enforcement route, depends on the deed and the occupier's legal basis. Compulsory possession is delivered through the lawful enforcement process by an enforcement officer.

Temporary accommodation costs may be relevant damages, but reimbursement is not automatic. Preserve evidence of necessity, duration and payment. If a tenant occupies the property, assess that person's rights separately.

Practical guidance

What to do, step by step

01 / 03

Read the handover terms

Include later agreements.

  • Identify the deadline and any temporary occupation right.
  • Establish who actually occupies the property.
02 / 03

Record the failure

Create a clear trail of the requested handover.

  • Propose a date and record through provable notice.
  • Keep replies and temporary accommodation receipts.
03 / 03

Choose the lawful route

Different clauses support different procedures.

  • Have the complete deed assessed for enforcement purposes.
  • Consider possession, damages and penalties without double-counting loss.
