Buying a Bulgarian home together without marriage: unequal contributions

Agree ownership shares, contributions and loan liability when buying together unmarried. Paying more instalments does not automatically increase your share.

The essentials

  • Cohabitation does not create matrimonial community ownership.
  • Contributions and ownership need consistent documentation.
  • A private agreement does not release a borrower from bank liability.

Unmarried partners buying a Bulgarian home should expressly agree who acquires which share and who pays what. Living together does not itself create the matrimonial community regime.

Contributions and title answer different questions

A larger contribution should be reflected in the ownership fractions or a separate clear arrangement. Paying more mortgage instalments later does not automatically increase a person's share. The law presumes equal shares unless otherwise established, but the title and actual legal arrangements matter.

Money from parents also needs explanation: who receives it, and is it a gift or loan? Payment references and written terms help prevent a dispute involving several families.

Your arrangement does not bind the lender automatically

Borrower, jointly liable debtor and owner of mortgaged property are distinct roles. Where joint and several liability is assumed, a private division of instalments does not automatically limit the bank's rights. Moving out or selling a share does not release a borrower without the required creditor consent.

Address occupation, expenses and a possible separation: valuation, a buyout proposal and a negotiation timetable. Do not assume these provisions can permanently exclude the statutory right to seek partition. Their purpose is an orderly process if circumstances change.
