Prepare a Bulgarian sale involving a child's share: court permission, representation, price protection and the conditions that must match the final deal.

The essentials

  • The court authorises the particular disposal.
  • Representation and conflicts need their own assessment.
  • The child's share of the proceeds remains their property.

Selling Bulgarian real estate belonging to a child requires more than the parents' signatures. Article 130(3) of the Family Code requires permission from the district court for the child's current address, provided the disposal does not conflict with the child's interests.

Permission concerns a particular transaction

Assemble the title, information about the child, evidence of value and proposed terms. Explain why selling serves the child and how their part of the price will be protected. A tax valuation and convenience for the adult sellers do not settle that assessment.

Permission is not an unrestricted authority to sell on any terms later. Compare the buyer, price, payment arrangements and other conditions with the court's order. Material renegotiation may require the scope of permission to be reconsidered.

Representation and the proceeds are separate questions

Who signs depends on the child's age and family circumstances. A conflict between parent and child requires a special representative. A parent buying the child's share should not assume they can represent both sides.

For inherited property, acceptance under inventory must also be examined. Sale proceeds remain the child's property; permission to sell does not make them freely available for family spending. Disposal of money in a child's bank deposit has its own legal requirements. Resolve these stages before promising the buyer an unconditional completion date.

Practical guidance

What to do, step by step

01 / 03

Document the child's share

Establish what is being sold and for how much.

  • Provide the acquisition instrument and evidence of the ownership fraction.
  • Compare the offer with available valuation evidence.
02 / 03

Explain protection of the proceeds

The proposed handling of the money matters.

  • Identify the account and recipient for the child's share.
  • Disclose any planned later use of that money.
03 / 03

Match the final agreement to permission

Check the conditions again before signing.

  • Compare the price and payment terms with the order.
  • Obtain advice on changed terms before accepting a deposit.
