Repairs will erase a building defect: preserving evidence before litigation

Preservation of evidence allows an advance court inspection or expert examination where repairs may erase evidence of a building defect in Bulgaria.

The essentials

  • The risk to evidence must be specific.
  • Experts establish technical facts, not legal liability.
  • The procedure does not replace the main claim.

Where repairs will cover a leak, crack or defective installation, proof need not wait for the main lawsuit. Article 207 of the Civil Procedure Code permits advance collection where evidence may be lost or become harder to obtain.

Explain the particular risk

Wanting an independent check is insufficient by itself. Describe the prospective dispute, what needs establishing and why a later inspection would not be equivalent. Planned removal, closing a structure or necessary emergency intervention may explain urgency.

Frame technical questions: location, likely causes, current condition and necessary remedial work. The expert does not decide legal liability for damages. Photographs, private reports and correspondence are useful attachments but are not automatically equivalent to court-collected expert evidence.

Where to apply

With pending litigation, apply to the court hearing it. Before litigation, an application to inspect property goes under Article 208 to the district court where it is located. A copy is served on the other party; the Act also addresses cases where that party’s name or address cannot be identified.

The procedure preserves evidence but neither awards damages nor decides the main dispute. Costs are considered later when that dispute is resolved. Do not treat the application as automatically suspending limitation or contractual periods. Where people or property are endangered, arrange necessary safety measures and documentation without delaying emergency action solely for the future inspection.

Practical guidance

What to do, step by step

01 / 04

Document the risk

Explain why inspection cannot wait.

  • Keep photographs and the repair plan.
  • Identify what will be removed or covered.
02 / 04

Prepare the application

Expert tasks must relate to the prospective dispute.

  • Identify the property and opposing party.
  • Frame specific technical questions.
03 / 04

Coordinate action

Evidence and safety must work together.

  • Arrange access and required costs.
  • Monitor the main claim’s deadlines separately.
04 / 04

Connect the report to the prospective claim

Preserved evidence must serve an identified claim.

  • Review the report for unanswered technical questions.
  • Compare its findings with contracts, notifications and provable loss.
