Buying Bulgarian property at an enforcement auction: title and possession
An enforcement auction does not replace title checks. Distinguish winning the bid, a final award order and formal delivery of possession.
Read article →Challenging a valuation before a first Bulgarian enforcement auction requires prompt action, an expert and costs. Do not wait for the award.
If the property valuation appears too low, act when it is notified. An appeal against the award after auction has limited grounds and is not a general second opportunity to dispute market value.
Article 485 of the Civil Procedure Code provides for a qualified expert’s opinion. Parties may challenge it within seven days of notification. The challenge must identify an expert meeting statutory requirements and fund the costs; otherwise no repeat opinion is prepared.
A useful objection identifies concrete omissions: incorrect area or status, unsuitable comparables or overlooked condition. Advertised asking prices alone do not prove market value. With two or more valuations, the Act uses their arithmetic average rather than automatically selecting the highest.
The general starting price is 80% of the property’s value. At the first auction it cannot be below an established tax valuation. The Act limits the challenge, averaging and tax-valuation rules to the first public auction; subsequent procedures require their own assessment.
An enforcement officer’s refusal to obtain a new valuation is appealable under Article 435. This does not make every disagreement with the figure independently appealable. Check proper notification, including inventory records, before calculating time.
