Restituted agricultural land: is the decision enough to sell?

When a Bulgarian restitution decision establishes title to a particular field, and how to check the plan, heirs and parcel identity.

The essentials

  • Not every decision means completed restitution.
  • The plan and parcel identity matter.
  • Current sellers must be traced through succession and transfers.

A Bulgarian agricultural restitution decision can serve as title, but not every decision in the file proves completed restitution of an identified parcel. Before a sale, establish the type of decision, whether it is final and whether it identifies the property.

Recognised entitlement and a specific parcel

The Agricultural Land Ownership and Use Act distinguishes restoration within old boundaries from restoration through a land redistribution plan. Under the statutory conditions, a final decision accompanied by a plan has the effect of a declaratory notarial deed. Preliminary recognition of an area or land category should not be presented as sufficient title to a selected field.

Land within urban territory and other special cases require examination of the applicable procedure. A missing plan may sometimes be recovered from the archive; in other cases it indicates incomplete identification. The document’s heading alone does not resolve this.

Who sells today?

A decision referring to a deceased owner may have been issued for the heirs collectively without specifying their shares. Later inheritances, partitions and transfers determine today’s sellers. The old redistribution-plan number must be linked to the current cadastral identifier.

Restitution review does not replace checks for encumbrances and existing land-use agreements. It answers the earlier question: does the seller have a completed, traceable right to this particular land?

Practical guidance

What to do, step by step

01 / 03

Obtain the full file

A single page may omit a decisive later act.

  • Request the decision and attached plan.
  • Check finality and amendments.
02 / 03

Connect the identifiers

The historic and current parcel must match.

  • Compare the redistribution plan and cadastre.
  • Resolve differences in area and boundaries.
03 / 03

Identify the sellers

The named restitution beneficiary may not be the present owner.

  • Trace inheritances and partitions.
  • Check encumbrances and leases before payment.
