A neighbour refuses access for repairs in Bulgaria: obtaining lawful entry

Scaffolding needs do not permit unauthorised entry. Document necessity, agree limited access or assess the applicable administrative procedure.

The essentials

  • Necessary access does not mean unauthorised entry.
  • Prove the works and the access area required.
  • Access carries responsibility to remedy resulting damage.

Where repairs cannot be carried out without access through a neighbouring property, Bulgarian law provides routes to obtain that access. It does not authorise climbing the fence. Establish the works, necessity and appropriate voluntary or administrative procedure.

Propose specific, limited access

A written proposal should identify works, area, duration, hours and protective measures. Technical advice can explain why another approach is unsuitable. A request to enter whenever convenient neither defines necessity nor helps resolve the dispute.

If refused, assess the planning-law route

Article 194 provides access for authorised or prescribed works on the basis of an order from the competent authority. Non-compliance is addressed through administrative enforcement; the contractor does not acquire a private power to force entry. An access order does not legalise otherwise unauthorised construction.

Damage caused by the works must be repaired promptly, or compensated under the applicable procedure where restoration is impossible. Record the yard before and after work and document reinstatement. Temporary repair access does not create a permanent route across the property.
