Buying in a Bulgarian gated complex: does the existing maintenance agreement bind you?

Check whether the statutory gated-complex regime applies and what agreement is registered against the apartment before accepting recurring fees.

The essentials

  • A registered special agreement may bind a later buyer.
  • The statutory conditions matter more than the advertisement.
  • Assess price changes, services and historical debts separately.

For a qualifying gated residential complex, Bulgarian law provides a special common-part management agreement between the investor and owners, with notarised signatures. An agreement registered under Article 2 is enforceable against subsequent acquirers. 'I never signed it' is therefore not always a complete answer.

Establish the applicable regime first

A fence and the marketing label 'gated complex' are insufficient. The definition requires a separate regulated plot, one or more residential condominium buildings, additional shared facilities and controlled external access. If those conditions are absent, analyse the agreement on its actual legal basis.

Read beyond the annual amount

Obtain the contract, amendments and registration details for your unit. Check services, power to change prices, duration, termination, reporting and penalties. Separate ongoing contractual charges from the seller's historical debts: buying an apartment does not automatically transfer every debt.

Facility access and fee disputes require individual assessment. Assume neither that every clause is valid nor that every charge can be ignored.

Practical guidance

What to do, step by step

01 / 03

Identify the complex's regime

Compare its organisation with documents.

  • Check the land unit and shared facilities.
  • Obtain the agreement and registration basis.
02 / 03

Assess the actual commitment

The annual fee is only part of it.

  • Review amendments, increases and extra charges.
  • Check duration, termination and service reporting.
03 / 03

Allocate sale-related risk

Do not accept another person's debt through vague wording.

  • Request information on the seller's arrears.
  • Specify what must be settled before handover.
