Can a Bulgarian basement or attic be sold separately from the apartment?

A separate door does not make a room an independent property. Determine whether it is an accessory, common part or lawfully separate unit.

The essentials

  • A key or separate entrance does not establish independent ownership.
  • Accessories, common parts and separate units follow different rules.
  • A share with allocated use is not ownership of a particular room.

A basement or attic is not freely saleable as a separate property merely because it has its own door and one person uses it. Establish whether it is an apartment accessory, a common part or an independent unit. That classification determines the transaction and necessary participants.

Three different legal positions

An accessory generally follows the principal property unless otherwise agreed, but that does not override special dwelling requirements or restrictions on separate transfer. A common part does not become private property merely through prolonged use or a padlock. An independent unit needs a legal and construction basis, not simply a number on its door.

Read the deed alongside the approved design

Identify which storage room belongs with the apartment and whether later transactions changed the position. A cadastral entry does not itself authorise unlawful subdivision. Creating separate physical parts may require approved designs and further steps under planning law.

Buying an undivided share with a promise to use a particular attic differs from acquiring that room as an independent unit. Define the actual subject matter and establish its status before paying an independent-unit price.
