Property encumbrance checks in Bulgaria: why a clean certificate does not settle every title question and what else to review before buying.
Read article →An enforcement auction does not replace title checks. Distinguish winning the bid, a final award order and formal delivery of possession.
At an enforcement auction under Bulgaria's Civil Procedure Code, the buyer acquires the debtor's rights when the award order becomes final. Winning the bid alone does not transfer ownership or guarantee immediate keys.
Establish whether the sale covers the whole property or an undivided share, its exact description and the debtor's title. An auction has special effects on mortgages and certain later rights, but 'all encumbrances disappear' is inaccurate. Each right needs analysis by type, date and enforceability.
Follow the particular announcement's participation, deposit and balance-payment requirements. General mortgage approval does not prove that funds can be drawn within the procedural deadline. Do not rely on an inspection that has not occurred.
The enforcement officer delivers possession on the basis of the final award order and required certificates. Identify actual occupiers and assess any rights they can assert. These rules should not automatically be applied to insolvency sales or public-revenue enforcement.
