Estate agency agreements: five questions before signing

Clear rules on commission, duration and services help both the client and the agent. Use these questions to prepare the conversation.

The essentials

  • Identify the services and the event that triggers commission.
  • Read the scope of exclusivity and the termination terms.
  • Put agreed clarifications into the document being signed.

What work are you commissioning?

A useful agency agreement starts with specific services. Does it include advertising, viewings, communication with candidates and negotiation support? Which documents do you provide and what updates should you receive?

A document headed “viewing record” may still contain contractual obligations. Read every page and attachment. Do not sign while important terms concerning the property, price or fee remain unclear.

When does commission become payable?

Check both the amount and the event that triggers payment: introducing a client, signing a preliminary agreement or completing the sale. Clarify whether the quoted fee includes applicable taxes and whether other expenses are charged separately.

Discuss what happens if negotiations fail, the buyer cannot obtain finance or the sale takes place after the agency agreement expires. The answer is not necessarily the same in every contract.

What does exclusivity mean in this agreement?

Clarify whether you may appoint other agents, advertise privately or sell to someone you already know. Distinguish a client introduced by the agent from a person with whom you were already in contact.

Illustrative example: an owner has an existing prospective buyer but signs broadly worded exclusivity terms. Recording and addressing that situation in advance can help prevent a later commission dispute.

How long are you committed and how do you end it?

Look for an end date, automatic renewal, notice periods and the method for sending notices. Read any penalty clauses and obligations that survive termination.

The final practical question is whether agreed clarifications appear in the signed text. Keep a signed copy and important correspondence. A consumer agreement may also require assessment under consumer protection rules; a term is not invalid simply because it appears unfavourable.

A review before signing lets you raise issues calmly and early. It need not imply conflict with the agent: its purpose is a clearer basis for working together.

Practical guidance

What to do, step by step

01 / 05

Write down the exact service you are instructing

Before signing, turn the general promise of “agency services” into a concrete scope.

  • Check whether the agreement covers advertising, viewings, communication with prospects and negotiation support.
  • See which documents you must provide and what information you should receive.
  • Read every page and attachment, including any document headed “viewing protocol”.
02 / 05

Identify exactly when commission becomes payable

The percentage is not enough — the triggering event matters.

  • Check whether commission is due on introducing a client, signing a preliminary contract or completing the final sale.
  • Clarify whether the stated price includes applicable taxes and whether there are separate charges.
  • State what happens if negotiations end without a sale or the buyer does not obtain finance.
03 / 05

Read exclusivity as a restriction, not a label

Check what you are actually allowed and not allowed to do during the term.

  • Can you use another agent or advertise the property yourself?
  • How is a buyer with whom you were already in contact treated?
  • Is commission or another consequence triggered by a direct sale?
04 / 05

Check the term and the exit route

You need to know not only when the agreement starts, but how it ends.

  • Look for an end date, automatic renewal and notice period.
  • Check how notice must be given and what penalty clauses apply.
  • See whether any obligations continue after termination.
05 / 05

Put verbal clarifications into the document you sign

Do not leave important arrangements only in conversation or messages.

  • Complete price, property, remuneration and other material fields clearly.
  • Record agreed exceptions and clarifications in writing.
  • Keep the signed copy and the material correspondence.
