Allocating use of a shared Bulgarian yard without dividing ownership

An arrangement allocating areas of a yard does not create separate properties. Check title, access, shares and possible judicial allocation of use.

The essentials

  • Allocated use does not partition title.
  • Access and common-part status constrain the arrangement.
  • The arrangement does not replace building approvals.

Co-owners can arrange who uses which part of a Bulgarian yard without making those areas separately owned properties. Allocation of use and partition serve different purposes.

Establish the yard's legal status

The land may be an ordinary co-owned parcel or a common part of a condominium. Read the titles to both land and buildings. A percentage in a deed does not automatically grant ownership of a chosen physical corner.

For ordinary co-ownership, Article 32 of the Ownership Act allows decisions on management and use by holders of more than half the shares. Management powers do not allow that majority to transfer another person's title or turn necessary common access into private land. Where no majority exists or its decision harms the common property, a co-owner can seek a district court determination.

Make the plan usable on site

Identify entrances, building access, installations and maintenance areas. Address parking, planting, costs and passage. Coloured rectangles are insufficient if one zone blocks the only entrance.

The allocation does not itself authorise a building, fence or alteration. Separate consents and construction documents may be required. Changes in owners, shares or physical conditions may call for reassessment; an old use plan should not be presented as permanent title to the marked area.

If the yard is a condominium common part, assess the decision-making regime separately under the Ownership Act and condominium legislation; do not mechanically apply ordinary co-ownership rules.

Practical guidance

What to do, step by step

01 / 03

02 / 03

Draw a workable use plan

Include access in the solution.

  • Mark entrances, installations and maintenance areas.
  • Specify costs and protection against obstruction.
03 / 03

Choose the legal route

Address future changes too.

  • Record agreement or the majority decision.
  • Consider judicial allocation under Article 32 if agreement fails.
