I repaired our co-owned house: must the other owners reimburse me?

Paying for repairs does not automatically increase your ownership share. Examine consent, necessity and evidence of expenditure and benefit.

The essentials

  • Repairs do not increase the payer's ownership fraction.
  • Consent and the type of works affect the legal basis.
  • Expenditure and the recoverable amount may differ.

Paying for repairs to co-owned Bulgarian property may create a monetary claim. It does not automatically increase your ownership share or make every invoice divisible between the other owners. The basis depends on the works and the owners' arrangements.

Separate necessary work from chosen improvements

Stopping a leak that damages the building differs from installing a luxury kitchen. Record the previous condition, reason for the work, scope and result. For improvements, the increase in value may matter and need not equal the contractor's price.

Consent changes the analysis. Look for a joint decision, instructions, later approval or an express objection. The rules on common burdens, management of another person's affairs and unjust enrichment are not interchangeable labels.

Prove more than a bank transfer

Connect invoices with the particular property and work actually performed. Keep quotations, quantities, photographs, the contractor's agreement and acceptance records. A technical assessment may be needed to establish both necessity and benefit.

Do not simply deduct the expenditure from everything you owe the other owner without checking the requirements for set-off. If partition proceedings are pending, accounting claims have their own procedural requirements and timing. Raise the issue before the case ends.
