Selling inherited property when one co-heir will not agree
Selling inherited property in Bulgaria when a co-heir refuses: joint sale, share transfers, voluntary partition and court proceedings.
Read article →You cannot selectively accept an inherited apartment and reject estate debts. Check prior actions, renunciation and acceptance under inventory before selling.
You cannot accept only an inherited apartment while rejecting debts belonging to the same Bulgarian-law inheritance. Article 54 of the Inheritance Act does not permit acceptance or renunciation for only part of an estate, conditionally or for a limited time.
Acceptance is not confined to a formal application. Conduct unequivocally demonstrating an intention to accept can also count. Selling an inherited property is particularly significant; do not treat a sale as a temporary step before deciding whether to accept.
Not every act of looking after the home has the same effect. Preservation, payment of an individual expense and disposal as owner require assessment in their factual context. Create a chronology instead of relying on the statement that you have signed nothing.
Renunciation follows the court procedure and is entered in the relevant register. It does not allow you freely to nominate the recipient of your share; the consequences follow inheritance law. Your own creditors may challenge a renunciation for their benefit where the statutory conditions are met.
Acceptance under inventory offers a separate route to limit liability, subject to deadlines and duties. Examine it promptly before selling or distributing assets. Gather information about loans, security and other assets: the apartment's value alone does not establish the financial outcome of inheriting.
