An owner must maintain a building in a safe technical condition. Where danger exists, the municipality may order repair, strengthening or, under the statutory conditions, removal. A disagreement between co-owners over payment does not eliminate these administrative obligations.
Under Article 196 of the Spatial Development Act, a commission appointed by the mayor establishes the condition and necessary works. Obtain its report, photographs, expert material and records of hearing interested parties. For removal under Article 195(6), whether the dangerous building can be repaired or strengthened is material; calling it an “old house” does not answer that question.
Check the addressee, structure, works and deadline. An order to repair a façade does not authorise unrestricted alterations. Required construction documents and safe organisation of works need separate review.
The order may be challenged under Article 215. Immediate danger can lead to preliminary enforcement, requiring separate assessment. Do not assume filing an appeal permits disregard of every safety measure.
The Act allows the municipality to carry out works under the prescribed procedure and recover the costs. Allocation between owners is a separate issue. Immovable cultural heritage follows the special Cultural Heritage Act regime, which should be identified at the first review.
